These terms are the agreement between you, a person or business running a shop on Stallkeep, and Design Studio Lab Ltd, which runs Stallkeep. Stallkeep is a trading name of Design Studio Lab Ltd, registered in England and Wales, company number 11222280. Registered office: 2 Damara Way, Ashford TN25 7FD. By opening a shop or using it, you agree to them.
The service
Stallkeep gives you a back office for your products, stock, purchasing, orders, invoices and accounts, an online shop, and connections to services such as payment providers, couriers and marketplaces. We keep improving it, so features may change; we won't remove something you rely on without telling you first.
Your account
- Keep your sign-in details safe and use two-step sign-in. You're responsible for what happens under your account and your staff's accounts.
- Give us accurate details and keep them up to date.
- Tell us straight away if you think someone else has got into your account.
Your shop and your sales
- Your sales are between you and your customers. You're responsible for your products, prices, descriptions, delivery, returns and refunds, and for following the law that applies to your shop, including consumer, product safety, data protection and tax law.
- Payments go to your own Stripe or PayPal account under your agreement with them. Stallkeep doesn't hold your customers' money.
- You must not use Stallkeep to sell anything illegal, to mislead people, to send spam, or to post fake reviews.
- For your customers' personal information, you are the controller and we are your processor. Our privacy notice explains how we handle it.
Goods you can't sell on Stallkeep
You are the seller of everything in your shop, and you're responsible for your listings. You must not list:
- Knives and weapons. Knives and offensive weapons can't be sold online on Stallkeep yet: the law needs an age and photo ID check on delivery, which Stallkeep doesn't offer yet (Offensive Weapons Act 2019). Some weapons can't be sold at all.
- Drugs and drug kit. Controlled drugs, psychoactive substances and the kit for taking them can't be sold (Misuse of Drugs Act 1971, Psychoactive Substances Act 2016).
- Tobacco, vapes and nicotine. Tobacco, vapes and nicotine products are for over-18s only, and Stallkeep has no age check at checkout yet.
- Prescription medicines. Prescription and pharmacy medicines can only be sold by a registered pharmacy (Human Medicines Regulations 2012).
- Counterfeit and replica goods. Fakes and replicas of branded goods are illegal to sell (Trade Marks Act 1994).
- Live animals. Selling pets and live animals needs a council licence, and Stallkeep doesn't support it.
- Fireworks. Fireworks are for over-18s only and need a licence to sell outside the permitted seasons (Fireworks Regulations 2004).
- Insurance and financial products. Insurance can only be sold by a firm authorised by the FCA, and Stallkeep doesn't sell regulated products.
- Anything else that is illegal to sell in the UK, or to sell to the person buying it.
Stallkeep checks listings automatically for these goods. A listing that matches is saved as a draft until we've looked at it; we don't delete it. We may hide a listing, or pause a shop's online store, when we believe it breaks these terms or the law, and we'll tell you why in your back office and by email.
Connections to other services
When you connect a service such as Stripe, PayPal, a courier, a marketplace or Google, your use of it is also covered by that service's own terms. We can't control those services, and they may change or stop what they offer.
When you connect a marketplace account (such as Etsy, eBay, Amazon or TikTok Shop, once each is available), you allow Stallkeep to read and write your listings, stock, orders and dispatch details there, only to keep them in step with your shop. You must follow that marketplace's rules, including its limits on contacting buyers and keeping their details. You can disconnect at any time. Our marketplace data page explains exactly what is read and written.
AI tools
AI tools suggest text and pictures. Check what they produce before you use it: you're responsible for what goes on your shop and what you send to customers. AI tools never publish or send anything by themselves.
Fair use
You must not:
- copy, decompile or reverse engineer Stallkeep, or try to get at its source code;
- scrape Stallkeep, or read it with automated tools other than the features and exports we provide;
- create accounts or shops automatically, or in bulk;
- use Stallkeep to build or improve a competing product;
- try to get into another shop's data, test our security without telling us, or overload the service.
If you find a security weakness, please tell us as our Trust centre explains.
Fees
Prices for plans, add-ons and AI credits are shown in your shop before you buy. Paid plans renew until you cancel them; you can cancel at any time and keep what you've paid for until the end of the period.
A shop plan (Studio, Professional or Signature) is agreed in a proposal after a call with us:
- A monthly plan can be cancelled at any time. You keep your shop until the end of the month you've paid for.
- A yearly plan renews each year unless you cancel it before the renewal date.
- The Launch programme fee is refunded in full if you cancel before your onboarding call; once onboarding starts it isn't refundable.
- A founding shop keeps its discount for as long as it stays, and in return agrees to a short case study and a testimonial within 3 months.
Your content and data
What you put into Stallkeep stays yours. You give us permission to store and use it only as needed to run the service for you. You can export your products and records, and close your shop, at any time.
Suspending or closing a shop
We may pause a shop that breaks these terms or the law, or that puts other shops or customers at risk. Where we can, we'll tell you first and give you a chance to put it right.
Responsibility
We work hard to keep Stallkeep running and your data safe, but we can't promise it will never be interrupted. We aren't responsible for losses we couldn't reasonably have foreseen, or for business losses such as lost profit. Nothing in these terms limits responsibility that the law doesn't allow to be limited, such as for death or personal injury caused by negligence, or for fraud.
Changes to these terms
- We tell you about a change by email to your shop's owner, and to your billing contact if you've given us a different one, and we list every change on our What's changed page with the date it takes effect. Each version is kept at its own dated address and never edited.
- Small changes, such as clearer wording, a typo or a new optional product, take effect when we publish them.
- For a change that matters, such as to fees, responsibility, how we use data, what can be sold or closing a shop, we give you at least 15 days' notice, and usually 30. If you'll need to change something in your shop because of it, we give you at least 30 days.
- We make a change straight away only when the law or a regulator requires it, or to deal with fraud, malware or a security risk. We still email you and say why it couldn't wait.
- If you don't agree with a change, you can export your data and close your shop before it takes effect. We refund plan fees you've paid in advance for the time after you close.
- A higher fee for a yearly plan only applies from your next renewal.
- When a change that matters takes effect, your shop's owner is asked to accept it before using the back office. Your online shop, orders and payments keep working meanwhile.
The law
These terms are governed by the law of England and Wales. Questions: [email protected].
